Participant Waiver, Release of Liability & Assumption of Risk

This Participant Waiver, Release of Liability & Assumption of Risk (“Waiver”) is entered into between the participant (“Participant”) and Monumental DC Running Tours LLC (“Company”) and is effective immediately upon booking, check-in, or participation in any tour or related activity.

1. Participant Eligibility

I affirm that I am 18 years of age or older and legally competent to enter into this agreement. Participation by minors is not permitted under any circumstances.

2. Description of Activity

I understand that Monumental DC Running Tours LLC (“the Company”) provides guided sightseeing tours conducted at an easy, conversational running pace through public spaces, including sidewalks, parks, and monument grounds in Washington, DC.

I acknowledge that this experience is not a fitness class, training session, athletic coaching program, or medical service. No instruction, advice, or guidance related to physical conditioning, performance improvement, or medical fitness is provided. I understand that the guide’s role is limited to route leadership and historical or cultural commentary, not supervision, instruction, or training.

3. Assumption of Risk

I understand that participating in a guided running tour involves inherent risks, including but not limited to:

  • Uneven, cracked, or damaged pavement, curbs, steps, and surfaces

  • Weather conditions including heat, cold, rain, snow, ice, and wind

  • Traffic, bicycles, scooters, pedestrians, animals, and other members of the public

  • Physical exertion, fatigue, dehydration, dizziness, or overexertion

  • Accidental slips, trips, falls, or collisions

I knowingly and voluntarily assume all risks, both known and unknown, associated with participation in this activity, including risks arising from the ordinary negligence of the Company, to the fullest extent permitted by law.

4. Participant Responsibility & Fitness Acknowledgment

I represent and affirm that:

  • I am physically capable of participating in an easy, conversational-pace running tour

  • I have not been advised by a medical professional to avoid physical activity

  • I will monitor my own condition and immediately stop or notify the guide if I feel unwell, unsafe, or unable to continue

I understand that I am solely responsible for my own health, safety, hydration, pacing, footwear, and decision-making during the tour.

5. Release of Liability

To the fullest extent permitted by the laws of the District of Columbia, I hereby release, waive, discharge, and covenant not to sue Monumental DC Running Tours LLC, its owner, guides, agents, contractors, or representatives from any and all claims, demands, actions, or causes of action of any kind, including claims based on negligence, arising out of or related to my participation in the tour, including but not limited to claims for bodily injury, illness, property damage, or death, except where such liability cannot be waived by law.

6. No Medical or Professional Advice

I acknowledge and agree that the Company does not provide medical advice, health assessments, fitness instruction, training plans, coaching, or professional services of any kind. Participation is voluntary and undertaken at my own discretion and risk.

7. Photo & Media Release

I grant Monumental DC Running Tours LLC permission to use photographs or video taken of me during the tour for promotional, marketing, or educational purposes, unless I notify the Company in writing (including email) before the tour begins that I do not consent.

8. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to conflict-of-law principles.

9. Acknowledgment & Signature

I acknowledge that I have read this agreement in its entirety, fully understand its terms, and agree to be bound by it freely and voluntarily.

By checking the acknowledgment box during booking, I agree that this constitutes a legally binding electronic signature equivalent to a handwritten signature under applicable law.

10. Severability

If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Effective Date: February 1, 2026.
