Participant Waiver, Release of Liability and Assumption of Risk
Effective February 2026
This Participant Waiver, Release of Liability and Assumption of Risk (“Waiver”) is entered into between the participant (“Participant”) and Monumental DC Running Tours LLC (“Company”) and is effective immediately upon booking, check-in, or participation in any tour or related activity.
1. Participant Eligibility
I affirm that I am 18 years of age or older and legally competent to enter into this agreement. Participation by minors is not permitted under any circumstances.
Company reserves the right to refuse or discontinue participation if, in its reasonable judgment, a participant appears unable to safely complete the tour or fails to follow safety instructions.
2. Description of Activity
I understand that Company provides guided sightseeing tours conducted at an easy, conversational running pace through public spaces, including sidewalks, parks, and monument grounds in Washington, DC.
I acknowledge that this experience is not a fitness class, training session, athletic coaching program, competitive event, race, or medical service. No instruction, advice, or guidance related to physical conditioning, performance improvement, or medical fitness is provided. I understand that the guide’s role is limited to route leadership and historical or cultural commentary and does not constitute supervision, instruction, coaching, or training.
3. Assumption of Risk
I understand that participating in a guided running tour involves inherent risks, including but not limited to uneven, cracked, or damaged pavement, curbs, steps, and surfaces; weather conditions including heat, cold, rain, snow, ice, and wind; traffic, bicycles, scooters, pedestrians, animals, construction, and other members of the public; physical exertion, fatigue, dehydration, dizziness, or overexertion; and accidental slips, trips, falls, or collisions. I understand that serious injury, permanent disability, or death may occur as a result of participation.
I further understand that tours occur in open, public spaces not controlled by Company. Company does not control traffic patterns, pedestrian behavior, cyclists, scooters, animals, construction activity, or the actions of third parties. I acknowledge that risks may arise from the conduct of other individuals or entities not affiliated with Company.
I knowingly and voluntarily assume all risks, both known and unknown, associated with participation in this activity, including risks arising from the ordinary negligence of Company, to the fullest extent permitted by law.
4. Participant Responsibility & Fitness Acknowledgment
I represent and affirm that:
I am physically capable of participating in an easy, conversational-pace running tour
I have not been advised by a medical professional to avoid physical activity
I will monitor my own condition and immediately stop and notify the guide if I feel unwell, unsafe, or unable to continue
I understand that I am solely responsible for my own health, safety, hydration, pacing, footwear, and decision-making during the tour.
5. Emergency Medical Authorization
In the event of illness, injury, or medical emergency, I authorize Company to contact emergency medical services (911) and to provide my name and relevant information to emergency responders. I understand and agree that I am financially responsible for any medical treatment received.
6. Release of Liability
To the fullest extent permitted by the laws of the District of Columbia, I hereby release, waive, discharge, and covenant not to sue Company, its owner, guides, agents, contractors, and representatives from any and all claims, demands, actions, causes of action, liabilities, damages, losses, or expenses of any kind, including claims based on ordinary negligence, arising out of or related to my participation in the tour, including but not limited to claims for bodily injury, illness, property damage, or death, except in cases of gross negligence or willful misconduct where liability cannot legally be waived.
This release applies to all claims, whether known or unknown, foreseen or unforeseen, and is intended to be as broad and inclusive as permitted by applicable law. This release is binding upon me and my heirs, executors, administrators, personal representatives, assigns, and estate.
7. Indemnification
To the fullest extent permitted by law, I agree to indemnify, defend, and hold harmless Company from any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from my participation in the activity or from my own negligent, reckless, or unlawful conduct.
8. No Medical or Professional Advice
I acknowledge and agree that Company does not provide medical advice, health assessments, fitness instruction, training plans, coaching, or professional services of any kind. Participation is voluntary and undertaken at my own discretion and risk.
9. Photo & Media Release
I grant Company permission to use photographs or video taken of me during the tour for promotional, marketing, or educational purposes, unless I notify Company in writing (including email) before the tour begins that I do not consent.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to conflict-of-law principles.
11. Severability
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. Acknowledgment & Signature
Each participant is required to individually complete and execute this Waiver as a condition of participation.
I acknowledge that I have carefully read this Waiver, Release of Liability and Assumption of Risk in its entirety, understand that I am giving up substantial legal rights, including the right to sue for ordinary negligence, and agree to be bound by its terms voluntarily and without reliance on any statements not contained herein.
By submitting this form, I agree that my typed name constitutes a legally binding electronic signature with the same force and effect as a handwritten signature.
